Hi there my tags ( car registration expires today ) . I am planning to sell my car to carmax this week.

Carmax does not care about registration status in general.

My question is if i sell my car to carmax with expired tags is the dmv in california going to go after me to collect the registration fees?

I was hoping to sell it before it expired but it won't happen due to factors beyond my control.

I may sound cheap but i find it stupid to pay 500 on registration only to sell the car few days later to Carmax who will in part make the new owner pay registration anyway

Please advise

You will be liable for the registration and any late fees.

You could get a certificate of inoperation stating that you aren't driving the car on the road which would allow you to register it at a reduced rate.

That's a good idea, but he technically isn't allowed to drive the car to CarMax if he gets this inoperable cert, right? I'm sure he won't get pulled over or get into an accident on the drive other there.

Pay the registration and smog to avoid headaches.

I don't think so. As long as you disclose to the buyer that the tags are late there is no penalty for selling it that way, if you lie to the buyer and tell them that the registration fees have been paid, DMV can give a credit to the new registered owner and pursue the late fees through civil action against the seller. However, if they are more than 30 days out, you could get it towed by driving it so that could be a problem.

Best thing for the OP to do is simply call Car Max and see what they say.

If you non-op a vehicle when the fees are past due, they remain past due. You just don't accrue new ones while it is not being driven. But, driving a non-op vehicle is a little risky a cop can tow it.

I'm going through this issue with CarMax in California right now.

On 10/26 (the date our registration expired), we received CarMax's offer and we were told that we had 7 days to make a decision. Great.

On 10/29, we went in to turn in our car and CarMax DID NOT HONOR THEIR OFFER.

They demanded that we pay the expired registration of $400.

I do not see the difference between turning in the car at 9pm on 10/26 or yesterday, 10/29. Either way, CarMax would be responsible for paying the registration.

We were never told that this was an issue and we had shown them the current/valid registration on 10/26. In fact, I called them over this past weekend to ask if there would be any issue with turning in a leased car a few days late and I was reassured that it wouldn't be a problem.

Even on CarMax's own website, they state:

What to bring with you:
• Your car's title or payoff information
• All parties listed on the title
• Valid photo ID for all titleholders
• All keys and remotes

https://www.carmax.com/articles/sell...op-6-questions

CarMax is not honoring their offer and I don't know what to do at this point.

Unless there was an agreement that they would pay $400 in back fees when they made their offer they don't have to honor it. Turning in a leased car a few days late is quite a bit different than selling them a car with $400 due in late registration fees.
